These Terms and Conditions govern the relationship between the customer (“Client”) and CleverEmpire Lda, operating under the commercial name Unique Journeys (“Company”, “we”, “our”, or “us”).

By booking any tour, experience, or service with Unique Journeys, the Client agrees to be bound by these Terms and Conditions.

2. Services Provided

Unique Journeys provides private and customized tourism services throughout Portugal, including but not limited to destinations such as Sintra, Nazaré, Fátima, Lisbon, Porto, Algarve, and tailor-made travel experiences.

All tours are subject to availability and operational conditions.

 

3. Booking and Payment

All bookings must be made through the official website or authorized booking channels.

Full payment is required at the time of booking unless otherwise stated.

Payments are processed securely via credit or debit card.

The booking will only be confirmed after payment has been successfully processed.

 

4. Cancellation Policy

4.1 Customer Cancellation

Customers may cancel their booking under the following conditions:

• Cancellations made at least 24 hours prior to the scheduled tour start time are eligible for a full refund.
• Cancellations made less than 24 hours before the tour start time are non-refundable.

All cancellation requests must be submitted via email.

4.2 No-Show Policy

Failure to arrive at the designated meeting location at the agreed time will be considered a no-show, and no refund will be issued.

4.3 Company Cancellation

Unique Journeys reserves the right to cancel, postpone, or modify tours due to circumstances beyond reasonable control, including but not limited to:

• Severe weather conditions
• Mechanical issues
• Road closures or transportation disruptions
• Strikes or civil disturbances
• Public safety concerns
• Force majeure events

In such cases, clients will be offered either:

• Rescheduling of the tour, or
• A full refund of the amount paid.

5. Itinerary Changes

While every effort is made to operate tours as planned, Unique Journeys reserves the right to modify itineraries, schedules, or destinations when necessary due to operational, safety, or external circumstances.

Such modifications do not automatically entitle the customer to a refund.

6. Client Responsibilities

Clients are responsible for:

• Arriving on time at the agreed meeting location
• Providing accurate booking information
• Following instructions from guides or drivers
• Respecting other participants and local regulations

Unique Journeys reserves the right to terminate a tour without refund if a client’s behavior is deemed unsafe, disruptive, or inappropriate.

7. Age Requirements

The minimum age for participation in tours is 5 years old.

Minors must be accompanied by a responsible adult at all times.

8. Liability Disclaimer

Unique Journeys acts as a tour operator providing transportation and tourism experiences.

While we take all reasonable measures to ensure safety and service quality, the Company shall not be held liable for:

• Personal injury, illness, or accident during tours unless caused by proven negligence
• Loss, theft, or damage of personal belongings
• Delays caused by traffic, weather conditions, or unforeseen circumstances
• Events beyond the Company’s reasonable control

Clients participate in tours at their own risk.

9. Force Majeure

The Company shall not be held liable for failure or delay in performing obligations due to events beyond its reasonable control, including but not limited to:

• Natural disasters
• War or terrorism
• Government restrictions
• Strikes
• Public health emergencies

10. Intellectual Property

All content on the Unique Journeys website, including text, images, branding, and materials, is the property of the Company and may not be reproduced without prior written permission.

11. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of Portugal.

Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the Portuguese courts.
